According to the Associated Press*, a recent synthetic estrogen lawsuit against producer Eli Lilly prompted a settlement after only two days of trial. The claimants, four sisters who filed in Boston, Massachusetts, all developed breast cancer and believe that it was a direct result of medications that their mother took during her pregnancies.
More than fifty women filed lawsuits in Massachusetts against companies that were involved with the marketing or manufacturing of the synthetic estrogen known as DES (Fecho, et al. v. Eli Lilly & Co., et al., No. 11-10152). The Melnick sisters recent victory may lead to several more quick financial settlements for women with similar circumstance.
DES (Diethylstilbestrol) is synthetic estrogen and was prescribed to women between 1940 and 1970 to prevent premature labor, miscarriage, and other types of pregnancy complications. Researchers* later linked DES prenatal exposure to a form of cancer of the vagina and cervix called clear cell adenocarcinoma.
The Melnick sisters are the first DES lawsuit claimants to go to trial for injuries related to breast cancer. They claimed that their mother took DES while pregnant with three out of four of her daughters and that the daughter who avoided DES exposure in the womb also avoided breast cancer. Their quick settlement bodes well for other claimants who feel that their cancer was a result of their mothers taking DES while pregnant.
