Court documents allege that she wore Skechers Shape-Ups regularly for a few months, which resulted in her sustaining two lower leg fractures and that the plaintiff’s severe lower leg injuries eventually required her to wear a boot and need invasive surgery. This case (Case No. 3:12-cv-00833-TBR), filed on December 15, 2012, named Skechers, U.S.A., Inc., Skechers, U.S.A., Inc., II and Skechers Fitness Group to be the defendants. The Skechers corporations are based in Manhattan Beach, California. As with previous Skechers lawsuits, this case has been filed in the U.S. District Court of the Western District of Kentucky, Louisville Division (MDL 2308).

Court documents allege that the plaintiff purchased Skechers Shape-Ups in 2010 and that Skechers advertising had convinced the plaintiff of the potential health benefits of Skechers toning shoes. This had led the plaintiff to believe that purchasing and wearing these toning shoes on a day-to-day basis would improve her health. When she started to feel extreme pain in her left ankle, she consulted her doctor. The plaintiff’s physician advised her that she had a tear in her left Achilles tendon. After one year of physical therapy and steroid treatments, the plaintiff was advised that she would have to undergo surgery for her alleged Skechers toning shoes injuries.
According to court documents, the rocker-bottom design of Skechers Shape-Ups contributed the plaintiff’s injuries. The plaintiff charges that the Skechers corporation has been negligent because the corporation has failed to perform safety testing after consumers have filed reports of Skechers injuries with the Consumer Product Safety Commission (CPSC). The CPSC database has more reports of injuries associated with Skechers toning shoes than it has with any other product in its database (as of May 2011).
